Weight Loss by Gina Inc. Terms of Service

Welcome to The Livy Method, a program and community operated by Weight Loss by Gina Inc. (“we,” “our,” or “us”). These Terms of Service (“Terms”) govern your purchase, subscription, and use of the Livy Method programs, website, app, and related services (“Services”). By purchasing, subscribing to, or using our Services, you agree to these Terms. Please read them carefully before completing your purchase.
Use of our public website is also governed by our Website Terms of Use.
1. The Livy Method App and Programs
The Livy Method App provides access to digital tools and content to support your wellness journey, including:
- Weight, water, movement, and sleep tracking
- Access to daily posts, check-in videos, and podcasts
- Journaling features to track meals and daily intentions
- Notifications and reminders for hydration and meals
- LivyAI, your digital assistant for Program-related questions (available to all members during active sessions; subscription members have access for as long as they are active subscribers)
- Access to exclusive Livy Method communities and seasonal groups (available to subscription members)
App functionality and content vary depending on your membership type – subscription or one-time purchase – as outlined in Section 8.
2. App Access and User Accounts
To use certain features of the Livy Method App, you may be required to create an account. You are responsible for maintaining the confidentiality of your login information and for all activity that occurs under your account. You agree to notify us immediately of any unauthorized use of your account. We may suspend or terminate your account if we detect misuse, unauthorized access, or behavior that violates these Terms.
3. Mobile Permissions and Device Access
The Livy Method App may request permission to access certain device features and data, including:
- Push notifications
- Camera or photo library
- Device storage
- Health or fitness data
You may manage these permissions in your device settings. Disabling certain permissions may limit use of specific app features.
4. Subscription Terms
4.1 Overview
A Livy Method Subscription provides continuous access to the Livy Method app, programs, and community content for a recurring monthly fee of $20 CAD. Subscriptions are powered by Recharge, securely integrated with Shopify.
4.2 Billing and Payment
- Your first payment is charged at checkout.
- Subsequent payments are automatically billed on the 1st of each month. Payment start dates may vary depending on when you join.
- By subscribing, you authorize Weight Loss by Gina Inc. to charge your selected payment method on a recurring monthly basis until cancellation.
- You will receive a confirmation email after purchase, an email 3 days prior to the next renewal payment date, and a receipt following each renewal payment.
- If your payment method fails, your access to the Services may be paused until payment is successfully processed.
4.3 Minimum Commitment
All subscriptions require a four (4) month minimum commitment (four payments). You may cancel anytime after your fourth payment has been processed. This may vary depending on sales and other promotions. For Early Bird purchasers who pay for the 4 months upfront, they may cancel their subscription after 4 months, not necessarily 4 payments.
4.4 Cancellation
- You may cancel your subscription at any time after the minimum commitment period by logging into your Shopify account.
- Cancellations must be submitted at least three (3) business days before your next billing date to avoid another charge.
- After cancellation, you will retain access to your program and app through the end of your current billing cycle.
4.5 Renewal and Reminders
Your subscription automatically renews each month unless cancelled. We will send an email receipt after each renewal and advance notice of any price changes or material updates to these Terms.
5. Program Participation Terms
By participating in any Livy Method Program, you understand and agree that:
- You are voluntarily choosing to follow the Program and should consult your healthcare provider before beginning any nutrition or wellness plan.
- Weight Loss by Gina Inc. is not a medical organization and does not provide medical advice or services.
- Individuals currently diagnosed with an eating disorder are not eligible to participate.
- You may be removed from any online group or community for behavior that violates community guidelines or disrupts others.
- All program content, materials, and communications are protected under copyright and trademark law. You agree not to copy, share, or distribute program materials without our written consent.
Health Disclaimer
The Livy Method and all related content, including information provided by LivyAI, are for general informational and educational purposes only and are not a substitute for professional medical advice, diagnosis, or treatment. Always consult your physician or another qualified healthcare provider before making any health, nutrition, or fitness decisions. We do not provide medical advice, and participation in the Program is entirely at your own risk.

Member testimonials reflect real experiences of individual users of The Livy Method but are not intended to represent or guarantee that anyone will achieve the same results. Individual outcomes vary based on personal effort, adherence, and other factors. Testimonials are provided voluntarily and are not paid endorsements.
6. AI Features and Disclaimers
The Livy Method App includes AI-powered features, including LivyAI. AI responses are automatically generated and are not reviewed by a human coach or healthcare professional. LivyAI does not provide medical, nutritional, or psychological advice. You understand that AI-generated content may be incomplete or inaccurate and should not be relied upon for health decisions. Your use of AI features is entirely at your own risk, and Weight Loss by Gina Inc. is not liable for actions you take based on AI responses.
7. Refund Policy
We want you to feel confident in your purchase. Refunds are available up until the start of a Live Program session.
Once a Live Program has begun and related digital content has been released (including access to app materials, posts, or LivyAI Program content), no refunds will be provided.
For subscriptions:
- If you request a refund before the Live Program start date, we will process a full refund of your most recent payment.
- After a Live Program begins, all payments are non-refundable, and your subscription will continue through the end of your current billing cycle unless you cancel under Section 4.4.
Because the Livy Method includes immediate access to digital resources and community features once a session launches, we are unable to offer refunds after that point.
8. Access Between Programs
The Livy Method offers different levels of access depending on whether you are a Subscription Member or a One-Time Purchaser.
8.1 Subscription Members
Active subscription members enjoy continuous, full access to the Livy Method ecosystem, including:
- Livy Method App (Full Mode) – ongoing access to all app features, including tracking, journaling, and community integration.
- LivyAI – full access to our digital assistant for Program-related questions during and between Live Program sessions.
- Program Switching – flexibility to move between Weight Loss and Maintenance streams after the completion of each Program. When active, the Maintenance Program offers continued support and guidance for members transitioning from weight loss into weight management, using the same app and subscription structure.
- Community & Seasonal Access – uninterrupted participation in private Facebook communities and exclusive groups such as Summer Club and Bridging the Gap.
Between 91-Day Programs, subscribers continue to have access to the app in General Tracking Mode and all community spaces.
8.2 One-Time Purchasers
Individuals who purchase a single Livy Method 91-Day Program without a subscription receive limited access as follows:
- Livy Method App (Freemium Mode) – continued access to basic tracking tools (weight, water, sleep, and movement) after the program ends. There will be no access to other features of the app such as content or historical data graphs.
- No access to LivyAI once the purchased Program concludes.
- No access to community spaces or seasonal groups (such as Summer Club or Bridging the Gap), unless separately purchased.
- Access to Livy Method content and app features will expire at the end of the purchased program, with limited Freemium Mode tracking available thereafter.
To regain full functionality, including LivyAI, community access, and seasonal programs, one-time purchasers may upgrade to a Livy Method Subscription. Please email our customer service team at: weightloss@livymethod.com for more details.
9. Third-Party Services and Integrations
The Livy Method App may include links or integrations with third-party services such as Facebook, Shopify/Recharge, analytics providers, or health data tools. We are not responsible for the content, availability, data practices, or performance of third-party platforms. Your use of third-party services is governed by their respective terms and privacy policies.
10. Modifications to Service
We may modify, update, or discontinue certain app features, programs, or subscription offerings at any time. If such changes materially affect your subscription or paid access, we will provide advance notice via email or in-app notification.
11. Limitation of Liability
To the fullest extent permitted by law, Weight Loss by Gina Inc., its officers, directors, and affiliates will not be liable for any indirect, incidental, or consequential damages arising from your participation or use of the Livy Method Services. Your sole remedy for dissatisfaction is to discontinue use of the Services. All Services and related content are provided “as is”, without any warranties of any kind, express or implied.
12. Eligibility and Age Restrictions
Users must be 18 years or older to use the Services. Users aged 16 or 17 may use the Services only with the consent of a parent or legal guardian. The Services are not intended for children under the age of 13.
13. User Responsibility for Health Data
You are solely responsible for the accuracy of any information you enter into the Livy Method App and for evaluating how that information applies to your personal circumstances.
14. Service Availability
We do not guarantee uninterrupted or error-free access to the app or Services. Delays, outages, or interruptions may occur and do not constitute grounds for refunds.
15. Data Retention
We may retain certain information as permitted by our Privacy Policy, including for legal, audit, and security purposes.
16. Community Platform Rules
Community participation occurs on third-party platforms such as Facebook and is also subject to the terms and policies of those platforms.
17. Prohibited Conduct
Users are prohibited from engaging in: - Harassment, hate speech, or abusive behavior - Sharing another user’s personal information - Attempting to misuse or manipulate LivyAI - Uploading harmful files, links, or content - Attempting to reverse engineer or interfere with the app
18. Severability and Entire Agreement
If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in full force and effect. These Terms constitute the entire agreement between you and Weight Loss by Gina Inc. regarding the Services.
19. AI Automated Decision-Making Disclosure
LivyAI does not make automated decisions that produce legal or similarly significant effects for users.
21. Governing Law and Dispute Resolution
For Canadian Members: These Terms are governed by the laws of the Province of Ontario, and any disputes shall be resolved in the courts of Ontario, Canada.
For U.S. Members: Disputes shall be resolved through binding arbitration under the rules of the American Arbitration Association (AAA). By using our Services, you waive the right to bring claims in court or participate in a class action.
22. Copyright and Intellectual Property
All materials, content, and features within the Livy Method app, website, and programs — including text, images, videos, graphics, and software — are the exclusive property of Weight Loss by Gina Inc. or its licensors. You are granted a limited, non-exclusive, non-transferable license to access and use the Services for personal, non-commercial purposes only. You may not copy, modify, distribute, or reproduce any materials without prior written consent.
